Outdated IRS forms could cost firms compliance in 2026

IRS tax forms are under constant revision, and RegTech provider Comply Exchange warns that keeping pace with the changes is becoming a growing challenge for organisations tasked with collecting tax documentation and managing withholding.

From Form W-9 to W-8BEN, W-8BEN-E, W-8IMY, W-8ECI and W-8EXP, Comply Exchange notes that having the right forms, processes and controls in place is essential to maintaining accurate records and supporting ongoing compliance.

Comply Exchange stressed that simply holding a form in a document repository is not proof that an organisation is using the correct version. The revision date printed on each form is central to determining whether the documentation collected remains valid and compliant.

The RegTech firm noted that revision dates become especially significant when new legislation alters reporting requirements, when the IRS introduces fresh certifications, or when new entity classifications and exemptions are added.

Comply Exchange also pointed to the rise of digital assets as a source of new reporting obligations, alongside shifting FATCA requirements, treaty provisions affecting withholding, and corrections issued after a form’s initial publication.

The IRS maintains a dedicated resource tracking post-release changes to forms and instructions, underlining Comply Exchange’s view that tax documentation should be monitored continuously throughout the year rather than treated as a once-a-year exercise.

Comply Exchange said that as businesses grow, so does the complexity of managing tax documentation, with more entities, counterparties, jurisdictions and forms quickly turning manual processes into a compliance bottleneck.
