In one common example, repeated deposits just under $10,000—clearly designed to avoid reporting thresholds—were processed as compliant transactions. Because the system lacked training on broader contextual patterns, it categorised “under 10K” as safe, overlooking the aggregated behaviour. This highlights how blind spots in data training can result in missed risks, undermining the purpose of compliance technology.

Detecting false negatives is uniquely difficult, as they are by definition the threats that go unnoticed. Firms can reduce this risk by introducing proactive safeguards such as independent back-testing of AI models. Red-team simulations, in which known illicit behaviours are fed into the system to test its resilience, can reveal whether gaps exist. Comparing results against external benchmarks, industry typologies, and regulatory enforcement cases further sharpens detection. Continuous scenario testing is particularly vital to ensure that blind spots are identified and addressed before regulators or auditors raise concerns.

Human oversight continues to play a vital role in reinforcing AI-driven compliance. Algorithms may process vast amounts of data quickly, but they lack the contextual judgement that compliance officers provide. Experienced analysts can identify anomalies that might not fit historical data patterns but nonetheless present clear risks. By embedding subject matter experts into model governance processes, firms ensure assumptions are challenged, limitations are documented, and corrective measures are implemented.

Regulators are increasingly paying attention to this issue, though formal frameworks are still in their early stages. Current rules tend to emphasise transparency, explainability, and the reduction of false positives, but guidance on measuring or reporting false negatives remains limited. Supervisors are, however, requesting evidence of robust model validation and independent testing, which indirectly pressures firms to strengthen defences against undetected risks. Those waiting for clearer rules risk lagging behind their peers.

Best practice requires firms to give false negatives the same level of scrutiny as false positives. A comprehensive approach that combines advanced technologies, rigorous testing, and expert oversight provides the strongest defence. Those that take action now to identify, document, and mitigate blind spots will not only bolster compliance but also demonstrate to regulators a serious commitment to managing AI-driven risks in full.
