Compliance teams in financial services are under unprecedented strain. The explosion in digital communications—from emails to chat apps—has pushed the volume of data requiring monitoring far beyond what human reviewers can handle.

Meanwhile, regulatory expectations have only tightened, leaving many firms searching for ways to keep pace without sacrificing accuracy or accountability, claims Saifr.

Artificial intelligence (AI) offers a powerful tool for processing and prioritising vast amounts of data. Yet some firms are making critical missteps—either relying too heavily on automation or avoiding AI entirely. Both extremes fall short.

The optimal solution lies in human-AI collaboration. AI excels at data processing and pattern detection, while compliance professionals provide the judgment regulators demand. Together, they create defensible surveillance systems that balance efficiency with regulatory rigour.

Regulators have repeatedly emphasised that human oversight remains essential. FINRA Rule 3110 requires supervisory systems to be “reasonably designed,” meaning firms must understand their tools and ensure outputs align with compliance obligations. Recent SEC discussions on AI underscored the same point: automation can enhance surveillance, but human validation is indispensable to interpret results and reduce false positives.

Real-world scenarios illustrate the risk of over-reliance on AI. A flagged term like “gift cards” might look suspicious to a machine, but a human reviewer may quickly recognise the context—such as legitimate holiday bonuses—preventing unnecessary escalation.

Leading firms are developing layered approaches. AI acts as the first line of defence, scanning communications for anomalies, potential policy breaches, or AML/KYC red flags. Humans then review alerts, assess intent, apply firm policies, and make final escalation decisions.

This approach also strengthens AML and KYC compliance. AI can detect unusual communication patterns, mentions of sanctioned entities, or discussions suggesting deviations from standard verification procedures. Human reviewers provide the context—distinguishing genuine compliance risks from routine customer interactions.

Marketing compliance presents another area where precision matters. AI can flag prohibited language or missing disclosures, but humans ensure materials meet fairness standards and regulatory expectations such as FINRA Rule 2210.

Firms are addressing ethical concerns by documenting AI decision processes, performing regular model testing, and ensuring all AI-generated alerts receive human oversight. The SEC has made clear that fiduciary duties cannot be delegated to algorithms; compliance decisions ultimately rest with humans.

Practical implementation involves clear governance, staff training, robust audit trails, defined escalation protocols, regular system testing, and ongoing regulatory monitoring. The goal is not to replace compliance teams but to help them scale effectively while maintaining accountability.

Firms getting this right gain significant advantages—reducing regulatory risk, lowering compliance costs, and improving operational efficiency. AI accelerates detection, but human judgment ensures defensibility, aligning with regulators’ expectations for both sophistication and oversight.

Looking ahead, financial institutions adopting human-in-the-loop systems will lead the way in compliance innovation. By combining technological speed with human expertise, they can meet growing surveillance demands while preserving the trust of regulators, clients, and stakeholders alike.
